Conditions of Participation
for participants in the voters’ raffle

Schlagwerk GmbH (hereinafter referred to as SCHLAGWERK) will provide a raffle/draw as part of the Schlagwerk Golden Cajon Award. Participation in the accompanying draw is determined according to the following Conditions of Participation.

Organiser

The draw will be hosted by Schlagwerk GmbH, Brückenstr. 10, 73333 Gingen an der Fils, Germany.

Participation requirements / draw

Participation in the raffle is free of charge and independent of the acquisition of goods or services. The draw will only include participants that have voted for an entry as part of the Schlagwerk Golden Cajon Award and have registered with all required details using the respective form. The draw will be made from all submissions and is guaranteed to follow the principle of chance. Each participant can only win once. Cash payment or transfer of the prize to other persons is excluded. The winners will be notified by SCHLAGWERK via email. Should the winner fail to confirm the win to SCHLAGWERK in writing (via letter, fax or email) within 21 days of receiving the notification, the claim to the win is forfeited and a replacement winner will be drawn following the same procedure. The winner will be informed explicitly of this requirement once again in the notification of the win. The participant is responsible for the correctness of the address provided.

Eligibility

All persons aged 18 and above are eligible to participate. In order to participate in the raffle/draw, participants must truthfully provide their personal details. Employees of SCHLAGWERK and their connected companies and raffle partners, including the relatives of the aforementioned groups, are excluded from participation. SCHLAGWERK reserves the right to exclude individuals from participation in so far as there are legitimate reasons for doing so (e.g. breach of the Conditions of Participation, double participation, undue influence on the raffle, manipulation, etc.). In such cases, winnings can subsequently be denied and reclaimed, if necessary.

Changes to the rules of participation and ending the raffle

SCHLAGWERK reserves the right to alter the Conditions of Participation at any time. Furthermore, SCHLAGWERK reserves the right to end or cancel the raffle and/or draw at any time for good cause without prior notice. This applies in particular to reasons that would disrupt or prevent the regular proceedings of the raffle/draw.

Limitation of liability

SCHLAGWERK is liable only for damages caused by them, their legal representatives or vicarious agents intentionally or as a result of gross negligence or by a breach of material obligations within the framework of the raffle/draw (cardinal obligations). Material obligations are those that are necessary for fulfilment or achievement of the purpose of the raffle/draw. In these cases, liability is limited to the foreseeable, typically occurring damage. This is without prejudice to any liability of SCHLAGWERK for damages resulting from injury to life, body or health.

Final provisions

Final provisions The laws of the Federal Republic of Germany apply.

Should individual provisions of these Conditions of Participation be or become invalid, the validity of the remaining provisions shall remain unaffected by this.

There is no right of appeal as regards the raffle/draw.
